Terms of Sale

1. GENERAL TERMS

These general terms of sale (“General Terms”) apply to the offer and sale of products through the website www.elleshop.it (“Site”).

To purchase products through the Site, customers must: (a) be at least eighteen years old or, if minors, be duly authorized by their legal representative; (b) be consumers, meaning individuals acting for purposes unrelated to their commercial, industrial, entrepreneurial, or professional activities; (c) be registered on the Site; and (d) possess a valid credit card.

2. SELLER IDENTIFICATION

The seller is Profumeria Elle SRL, an Italian company with its registered office at Piazza Vittorio Emanuele II, 68, 00185 Rome RM, VAT number 13759001004.

3. PRODUCTS

Product information is available on the Site and is provided in accordance with Articles 52 and 53 of the Consumer Code.

Profumeria Elle strives to ensure that the product details, descriptions, and images on the Site are correct at the time the information is posted. However, to the extent permitted by law, it does not guarantee that these details, descriptions, or images are accurate, complete, reliable, updated, or error-free.

The products described on the Site are for personal use only. Customers are not allowed to sell or resell the products or any promotional product samples they may receive. Profumeria Elle reserves the right, with or without notice, to terminate or reduce any supply of products or promotional samples if, in its discretion, it deems that the customer's behavior may violate these General Terms.

4. PRICES

All product prices displayed on the Site include VAT at the current rates and are expressed in Euros. Shipping costs, which are indicated separately in the order form, must be added to the product prices.

Profumeria Elle regularly checks that all prices displayed on the Site are correct but does not guarantee the absence of errors. In the event of an obvious pricing error, Profumeria Elle will offer the customer the option to purchase the product at the correct price or to cancel the order.

5. ORDER SUBMISSION

The customer will be guided through the process of submitting an order with a series of simple instructions on the Site.

To submit an order, the customer must select the quantity of products they wish to purchase in the quantity box.

To add the selected product to the cart in the desired quantity, the customer must click the "Add to cart" icon. At any time during shopping, the customer can view the products in the cart by selecting the icon at the top right of the page, where the number of added products will be displayed, and then selecting the "Go to cart" option. The customer can save a product as a favorite by selecting the heart icon on each product. The product will then be moved to the "My Wishlist" page in the footer section under "My Elle." To access the "My Wishlist" page from any computer, the customer must register or log in to their account.

The customer must follow the instructions provided on the Site to complete the order. The customer can always correct errors in the entered data or change the cart content by adding or removing one or more products, or cancel the entire order before submission. By submitting an order, the customer acknowledges and declares that they have read all the instructions provided during the checkout process and agree without reservation to these General Terms. The customer can submit an order for the selected products through the Site by clicking the "Confirm" icon at the end of the purchase procedure.

Once the order is submitted, a "Thank You" message will appear, and the customer will receive an order confirmation email shortly. In accordance with Article 53 of the Consumer Code and Article 13 of the E-commerce Decree, the order confirmation email contains a summary of the General Terms, the essential characteristics of the products purchased, detailed pricing and payment methods, shipping costs, information on the conditions and methods of exercising the right of withdrawal, the geographic address for complaints, information about customer support services, and existing commercial warranties.

If the order receipt confirmation email is not received within 24 hours of submitting the order, the customer is invited to seek assistance by calling 06 9151 1288.

For questions or problems during the order process or for information about previously submitted orders, the customer is invited to call 06 9151 1288 or email info@elleshop.it. For faster service, it is recommended to have the order number available.

6. PRODUCT AVAILABILITY

To cancel an order due to temporary unavailability of a product before shipment, the customer can call 06 9151 1288 or email info@elleshop.it.

Once the product has been shipped, the order cannot be canceled or modified. However, shipped products can be returned in accordance with these General Terms.

7. DELIVERY

All orders are processed and delivered on weekdays (Monday-Friday, excluding holidays). Orders placed on Saturdays and Sundays will not be processed until the following Monday.

No product deliveries will be made to PO boxes.

Shipping costs are the customer’s responsibility and are indicated separately in the order form and transport document. Shipping is free for purchases exceeding the amount specified on the Site.

8. RIGHT OF WITHDRAWAL

Profumeria Elle's goal is to offer its customers the best cosmetic products. If a product does not meet the customer's expectations, in accordance with Article 64 of the Consumer Code, the customer has the right to withdraw from the contract, without specifying the reason, within 14 (fourteen) working days from receipt of the products.

The customer can communicate their intention to withdraw via email to info@elleshop.it, indicating the order details, including the order number and the description of the products to be returned. Inside the delivered package, the customer will find a transport document with order details and instructions on how to return the products. If the products listed on the transport document do not match the ones delivered, the customer is invited to contact Profumeria Elle immediately by calling 06 9151 1288.

It is recommended to send the package via registered mail with return receipt. Profumeria Elle is not responsible for products lost during transport.

The above provisions apply only to products purchased on the Site. Returns or exchanges for purchases made in a MAC store or with an affiliated retailer cannot be made through the Site.

9. APPLICABLE LAW AND JURISDICTION

These General Terms are governed by Italian law and must be interpreted in accordance with Italian laws.

Any dispute arising from the interpretation, validity, and/or execution of these General Terms will be subject to the exclusive jurisdiction of the judge in the customer's place of residence or domicile.
